RETURNS AND WARRANTY

TAKTIK TENNIS™ is made from high quality materials for all items and is supplied in a robust nylon carry bag for convenience and protection. Also included is the weather protection bag that is to be placed over the head of TAKTIK TENNIS™ to protect from the environment when not in use. This will give you many years of enjoyment and reliability. In addition, we have provided 2 high quality aluminium strung rackets so that when you play, you play for real.
TAKTIK TENNIS™ extends the following limited warranty for the purposes of playing interactive tetherball using the product and App in accordance with instructions and guidelines.
The limited warranty applies for the following components and for the time period indicated:
TAKTIK TENNIS™ Plastic moulded Head including internal components – 12 months
TAKTIK TENNIS™ Blow moulded Base – 12 months
TAKTIK TENNIS™ adjustable pole with spring – 12 months
TAKTIK TENNIS™ Carry bag including zippers – 12 months
TAKTIK TENNIS™ Rackets– 12 months
TAKTIK TENNIS™ Ball and string are NOT included under any provisions of this limited warranty
TAKTIK TENNIS™ Batteries are NOT included under the provisions of this limited warranty
2. Liability for subsequent defects
2.1 We will replace Products and Services which fail to comply with the provisions of the Competition and Consumer Act 2010 if delivery is made in Australia or which shows a defect. If you claim that the item is defective the following conditions apply:
2.2 The defect must be reported to us within 14 days of becoming apparent;
2.3 The defect results only from faulty materials and manufacture;
2.4 You have returned the defective Products and Services or parts to us if we have so requested.
2.5 If we agree that we are liable, we will refund the cost of return carriage and will repair or replace the Products or Services free of charge.
2.6 If we repair or replace the Products and Services, you have no additional claim against us either under this agreement or by statute or common law, in respect of the defect.
2.7 The limited product warranty does not apply to non TAKTIK TENNIS™ products, cosmetic damage or normal wear and tear or products that are misused, abused, mishandled or otherwise not used as intended or in accordance with TAKTIK TENNIS™ instructions.
3.1 These provisions apply in the event you return any Products to us for any reason.
3.2 We do not accept returns unless there was a defect in the Product at the time of purchase, or we have agreed in correspondence that you may return them. Before you return Goods to us, please carefully re-read the instructions and check that you have assembled it correctly and complied with any provisions relating to the batteries and operation.
3.3 The Products and Services must be returned to us as soon as any defect is discovered but no later than seven 14 days.
3.4 So far as possible, Products and Services should be returned in good condition (ie not damaged or rendered unusable) Whether the Goods are in good condition shall be determined by TAKTIK TENNIS™.
3.5 You must tell us by email message to firstname.lastname@example.org that you would like to return Products and Services, specifying exactly what Products and Services and when purchased and giving full details of the defect or other reason for return. We will then issue a Returns Note. If you send Products and Services to us without a Returns Note, we may not be able to identify sufficient details to enable us to attend to your complaint.
3.6 The Products should be securely wrapped, include our delivery slip and be at your risk and cost.
4. Limited Warranty
4.1 TAKTIK TENNIS™ warrants to the original purchaser that our Products and Services shall be free from defects in materials and workmanship under normal use for a period of twelve (12) months from date of purchase.
4.2 If we agree the Goods are faulty we will, at your option,
4.2.1 Replace the Goods with a new or refurbished item, or
4.2.2 Refund your payment.
4.3 This Limited Product Warranty does not apply to
4.3.1 Replacement Goods
4.3.2 Non TAKTIK TENNIS™ Goods
4.3.3 Cosmetic damage or normal wear and tear,
4.3.4 Goods that are misused, abused, mishandled, or otherwise not used as intended or in accordance with TAKTIK TENNIS™ instructions. We reserve the right to verify that you are the original purchaser and that the defective Goods are genuine TAKTIK TENNIS™ Goods.
4.4 All the conditions, warranties or other terms implied by the law of any country other than Australia are excluded from this agreement to the extent permitted by law.
4.5 If delivery was made to an Australian address, you are protected by the Competition and Consumer Act 2010.
5. Exclusions and limitations
5.1 TAKTIK TENNIS™ warranty applies when the goods are purchased through an authorised reseller or this website. The warranty does not apply to any non TAKTIK TENNIS™ goods, even if packaged or sold with the product. This warranty applies only to the normal use of the Goods, normal wear and tear excepted, in accordance with written use instructions, if any, provided with the Products and Services (either in writing or through a hyperlink to such instructions).
This warranty does not apply to damage caused by not using the weather protection cover outside, or accident, abuse, misuse or modification of the Goods.
6. Damages limitation
6.1 To the maximum extent permitted by law, TAKTIK TENNIS™ is not responsible for direct, or special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including without limitation any costs of replacing personal property, or costs of recovering or reproducing any program or data stored in a device used with the TAKTIK TENNIS™ products.
7. Consumer protection
7.1 Our goods come with guarantees that cannot be excluded under the Australia Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
8. How do I make a warranty claim
8.1 Please send an email message to email@example.com with your order details and a description of the fault or damage. Including photographs of any fault helps a lot in speeding up claims
8.2 If you bought TAKTIK TENNIS™ from a shop then go directly to that store and they will assist you.
